Commercial Courts Conferences in Vrsac and Kladovo, April 2016

In line with the findings of the Commercial Courts Needs Assessment the MDTF for Justice Sector Support in collaboration with the IFC DR Project and Appeal Commercial Court initiate implementation of recommendations focused on increasing capacities and quality of the Commercial Courts stakeholders.

By now, two World Bank Group projects cooperated in organizing:

 
  • Conference on the case-law harmonization, addressing results of the commercial courts’ work for the first quarter of 2016, with a comparative review of the last year’s results, held in Kladovo on April 21.
    President of the Appeal Commercial Court, Mr Nikolic, presented new Rules of procedure and informed Commercial Court president that case-law harmonization is one of the priorities according to the new Rules. Mr Nikolic and Ms Jasminka Obucina, had presentation of the relevance of case-law harmonization, work of the Appeal Commercial Court case-law department and encourage judges to follow case-law and judicial positions. Furthermore, the judge of the Appeal Commercial Court, Ms. Matkovic Stefanovic, gave overview of submitted complaints against Commercial Court judges and work of Commercial Courts. There were 26 participants at the conference, court presidents and heads of courts case-law departments.
    In addition, Mr Nikolic briefly presented backlog assessment. However, it has to be seen what will be the influence of the new Law on enforcement and security.
  • Conference on the implementation of the Law on enforcement and security, introducing the novelties, general provisions and relation between bankruptcy, liquidation and enforcement, held in Vrsac on April 26-27.
    Speakers at the conference presented novelties and challenging issues in the new Law, type of litigations, legal remedies and transitional provisions. After the presentations a discussion took place. Judges were interested to hear how new legislation will effect on their daily work. There were 78 participants at the conference.

The feedback from stakeholders on these two workshops has been very positive and the MDTF JSS is planning to continue support of the Commercial Courts.
